Legal Limitations of EAP Confidentiality

Employee Assistance Programs (EAPs) are most effective when clients are assured their confidentiality is respected and guarded. At Employee & Family Resources, Inc.®, contacts with EAP counselors are protected by state and federal confidentiality regulations. Information shared with the EAP is not disclosed without the client's written permission, except when required by state or federal laws related to counselors.

Information may be disclosed without written permission under the following circumstances:

  • The abuse/neglect of minor children.
  • The abuse/neglect of dependent adults.
  • When there is an immediate danger of harm to self or others.
  • Under subpoena or court order.
When a manager refers an employee to the EAP because of job-related problems, the employee will be asked for written permission to disclose specific limited information. No information is released without written, client-authorized permission except under the rare circumstances noted above.
